Terms of Service

These Terms of Service ("Terms") govern your use of the PressGEO platform, websites, and related services (the "Service") provided by PressGEO, Inc. ("PressGEO", "we", "us"). By accessing or using the Service you agree to these Terms.

1. Eligibility & Authority

You must be of legal age in your jurisdiction. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

PressGEO provides AI visibility monitoring, generative-engine optimization tooling, comparison and best-of content, and optional press release publishing and syndication. Specific features available to you depend on your plan.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or deceptive purpose.
• Send spam or publish content you do not have the right to distribute.
• Infringe intellectual property, privacy, or publicity rights of others.
• Interfere with the Service's security, probe or scrape it, or upload malware.
• Attempt to reverse engineer, resell, or redistribute the Service except as expressly permitted.

4. Accounts & Content

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. You retain ownership of content you submit. You grant PressGEO a limited, worldwide, non-exclusive license to host, process, and display your content solely to operate and improve the Service and, where you publish content, to syndicate it as you direct.

5. Intellectual Property

PressGEO and its licensors retain all rights, title, and interest in the Service, including software, documentation, branding, and the datasets we compile. You receive a limited, non-exclusive, non-transferable right to use the Service within your selected plan.

6. Payments, Subscriptions & Billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, taxes, cancellation, and refund mechanics, please refer to Paddle's Buyer Terms and our Refund Policy. Subscriptions renew automatically at the end of each billing period unless cancelled.

7. Service Levels & Warranties

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Limitation of Liability

To the maximum extent permitted by law, PressGEO will not be liable for indirect, incidental, consequential, special, or punitive damages, or for loss of profits, data, or goodwill. Our aggregate liability for any claim will not exceed the fees you paid to PressGEO in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be limited by law.

9. Indemnification

You agree to indemnify and hold PressGEO harmless from claims arising out of content you submit, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

10. Suspension & Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel at any time. Upon termination, your right to use the Service ends; we will provide a reasonable window to export your data before deletion where applicable.

11. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, unless otherwise required by applicable law.
